Welcome to Tamari & Kamari: Twins of the Oba ("the Game"). These Terms of Service ("Terms") govern your access to and use of the Game, provided by the Tamari & Kamari development team ("we", "us", or "our"). By downloading, installing, or playing the Game, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Game, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Game.
2. Eligibility
The Game is intended for users of all ages. If you are under 13 years old, you must have permission from a parent or legal guardian to use the Game. By using the Game, you represent that you have obtained such permission if applicable.
3. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Game for your personal, non-commercial use on compatible iOS devices, subject to these Terms. You may not:
- Copy, modify, distribute, sell, or lease any part of the Game.
- Reverse engineer, decompile, or disassemble the Game.
- Use the Game for any unlawful purpose.
- Attempt to gain unauthorized access to any systems or networks connected to the Game.
- Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software designed to modify the Game experience.
4. In-App Purchases
The Game may offer in-app purchases ("IAP") that provide access to additional content, features, or virtual items. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies.
5. Virtual Items
Virtual items, currency (such as cowries, suya, or Oba tokens), blessings, artifacts, and other in-game content have no real-world monetary value and cannot be exchanged for real currency. We reserve the right to modify, manage, regulate, or eliminate virtual items at any time.
6. User Conduct
You agree to use the Game in a manner consistent with all applicable laws and regulations. You must not:
- Engage in any behavior that is abusive, harassing, or harmful to other users.
- Interfere with or disrupt the Game's servers or networks.
- Transmit any viruses, malware, or other harmful code.
- Impersonate any person or entity.
7. Intellectual Property
All content in the Game, including but not limited to characters (Tamari, Kamari, and all NPCs), artwork, music, sound effects, voice acting, storylines, game mechanics, and software, is the intellectual property of the Tamari & Kamari development team and is protected by copyright, trademark, and other intellectual property laws.
The names "Tamari & Kamari," "Twins of the Oba," character names, and associated logos are trademarks of the development team.
8. Updates and Changes
We may update the Game from time to time to add new features, fix bugs, or improve performance. We may also update these Terms. Continued use of the Game after any changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes.
9. Termination
We may suspend or terminate your access to the Game at any time, without prior notice, if you violate these Terms. Upon termination, your license to use the Game ceases immediately.
10. Disclaimers
The Game is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Game will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Game.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
